Hello,

I was wondering if there is anyone who's adjustment of status was marriage based and been married for less than 2 years at time of interview and got a 10 year green card instead of a 2 year. If so, please give a timeline between your interview and 2nd marriage anniversary. your responses will be greatly appriciated.

Thanks

Nobody.

A few people who had a nice IO at the interview and were a few weeks from their 2nd anniversary at the interview date, were asked to mail something to the IO and he approved them after the anniversary so they would get the 10 year GC.

Thanks, thats what I thought. I think my brother got lucky.
At the time your brother's card was approved (I mean the final on-paper approval with an approval letter or green card, not the interviewer telling him of the approval) were the 2 years of marriage completed yet? Sometimes they directly give a 10-year card if the 2 years have been completed by the time they are processing the final stamps of approval and producing the card, even if the 2 years were not complete at the interview.

A little due deligence is needed. What is the approval date for the I-485? This may not be the same date the interview took place. If it is before the 2nd anniversary of the marriage, the GC is incorrectly given a validity of 10 years. Even if USCIS made this mistake, guess what, the applicant is responsible for filing an I-751. So please ask your brother to verify the approval date of the GC. This has the potential to land him in hot water 2 years down the road.
