Date for notice for i485/i130 sep 20th

interview date dec 5th

married to usc for 1 yr. dating 5 yrs+, living together since we started dating.

had lots of proof. got grilled at interview.

io kept i-94, wrote note in passport saying he retained it.

after interview gave us letter asking for documents related to police record(my record). we needed to submit within 3 week time frame.

All clear, did so in 4 days. went to office, handed over to io.

been over a month no response.

notice date is also over the 4 month timeframe on site. what do you recommend?

thanks a ton

Lawful Permanent Residents who got married before obtaining a Green Card are not required to file an Immigrant Petition on behalf of their spouse (or any children born before becoming a Lawful Permanent Resident). A spouse and eligible children of a Lawful Permanent Resident in this category may apply for a Green Card without having an approved Immigrant Petition. This process is known as "accompanying" or "follow to join." Lawful Permanent Residents who have "adjusted" to Lawful Permanent Resident status in the U.S. must file Form I-824, Application for Action on an Approved Application or Petition in order to notify the appropriate consulate that their spouse will "accompany" or "follow to join." Click here to get started on the Form I-824, Application for Action on an Approved Application or Petition.

Just wait for your response, wonder why you were grilled like a turkey burger....:( Were you thoroughly prepared for the interview?

What was the charge and the disposition of the criminal case? Was a waiver required? A waiver request would require further review. Even if no waiver were requested ALL cases involving a beneficiary with any criminal record requires a secondary level of review. It is a matter of routine. Added layers of processing always add time to the wait for a decision. Not unusual at all.

Was as prepared as I thought we should have been. maybe not enough. had everything required. Joint ownership of business, photos, leases and bank statements from 5 years running, tax returns, all requisite documents.

No charges were filed. I had a notarized police statement saying the same(this was supplied 4 days later). Was not asked for a waiver?

should I wait it out or setup infopass?

thanks

It's been over the 60 days that the io said that they would take to get back to us with their decision when we handed over the police statement. Should I make an infopass appointment?

Are you dealing with the NYC district by any chance? They are required to do more in spousal cases. It is a Stokes interview based on a court case. IF in NYC, google for Stoke interview.

Yes NYC district.
So I guess we will have a Stokes interview coming up. Not worried as our case is genuine. I wish they had just done this automatically instead of making us wait it out.

BigJoe5 can you explain this to me please: It is a Stokes interview based on a court case.
OK did some research I guess you are referring to 1976 ruling.

From what I can see however, is most couples get their stoke(s) interview letter within a a couple of weeks of their intial interview. However we haven't heard back since handing over all the requested documents. Its been 2 moths+.

Thanks!
