My 6 year H1-B is expiring on March 21, 2008. I have valid H1-B papers till March 21, 2008. My I-94 that is attached to my passort says admitted until November 3, 2005.

1. When my H1-B expires on March 21, 2008, do I still have the 180 grace period to stay in the US? Or should I leave before March 21, 2008?

2. Righ now (the date is March 2, 2008) am I legal or illegal?

Please let me know. Thank you.

Additional info:

The I-94 that is attached to my H-1B says "valid till March 21, 2008" So do I still have 180 days of grace period? or do I need to leave the country before March 21, 2008?

In general, staying beyond I-94 is not legal. Since your I-94 is valid til Mar 21, you are legal at this moment.
When H1 is expired, law says you have 10 days grace period to pack the stuffs to leave. I'm not 100% sure if this 10 days is allowed beyond I-94 expiration, but I THINK it is.
Talk to the lawyer about 10 days grace period.

There is no 180 days grace period by the way.

Correct there is no grace period of 180 days - it is the 10 days after the I-94 expiry. BTW - the new I-94 overrides the old one, you should staple the new I-94 (over the old one) on the passport.

Hi Folks, Thanks for all your advice. I just re-captured 20 days that I was out of the country. I filed the papers through the university. So now I can stay till April 11. Which means I have to leave by April 21.
