Query in Form I-129

Hi,

I am originally from India and had entered US on F-1 visa in August 2007 for a Masters degree. I graduated on August 10, 2009. I shifted to F-1 OPT from Sept 1, 2009 and started working in a company from the same date. My employer is thinking of applying for my H-1B visa for FY-2010 since the visas are still available this year.

We were confused on what to fill up in form I-129 for the following questions:
1. Requested Nonimmigrant Classification: "H-1B1" or "H-1B"?
2. Basis for Classification: "New Employment" or "Change in Previously Approved Employment"?
3. Petition Receipt Number: "N/A" or "I-797 number approving my F-1 OPT"?
4. Prior Petition: "N/A" or "I-797 number approving my F-1 OPT"?
5. Requested Action: option "b"?

Form i-129 inquiry

Hi,

Maybe you can also help me in filling up form I-129 for H1b visa.
I'm a sole proprietor and will petition using H1B visa. I'm confused on how to answer the ff:

1. Being a sole proprietor, how do I fill up Part 1 of form I-129? Will I use my individual name or my company name ?

2. On Part 5 - item #9: Type of petitioner : As a sole proprietor, which one should I check, US citizen/permanent resident or organization?

I would also like to know what should I fill in "Requested Nonimmigration Classification". I am from India and would be performing services in a specialty occupation. Should it be simply H-1B or H-1B1?
