Query for paystubs during H1 transfer

I was without a job for 7 months from Oct 2002. I got a job in May '03 and my employer filed for H1 transfer (premium processing). The INS/BCIS has raised a query and has asked for paystubs between Feb '03 and Apr '03, during which period I was unemployed.

What should be my response to INS in regards to the query? What are the chances that my H1 will be rejected? I understand that one of the scenarios would be for me to go back to India to get my visa stamped, if INS approves my H1. I have also heard from friends that the INS might consider "certain reasons" as acceptable and approve the petition and give a valid I-94 in such cases.

Can anyone tell me what is the best course of action that I can take? Please let me know the pros and cons.

My friend had this experience before

You tell the truth that u didnot get paid those months because of training u have attended at some other employer whose project got cancelled and you came back to ur first employer.

So no one paid during that time.... ur first employer is safe..... because u were with another company training.

And you have a vaild reason to coverup....

NO KIDDING ..... this worked with my friend....

I am not lawyer .... only one of u
