I got a Query asking for ability to pay and Wducation Evaluation..

I have done my evaluation from Mornign Star which states that equivalent to bachelors in Computers science..

I have filed in EB2 and have experince of 8 years realtime..

Will that suffice please post your suggestions..hope i will get thru the
query quandrum.

Try doing evaluation from trustforte. Looks like USCIS likes it. I am not sure why do they want re-eval when it was computer science the first time. Did the labor say it will allow 5 years of experience on lieu of Masters ?

How large is your company ? Generally ability to pay comes only if company is less than 100 people.
 
140 RFE for 10/03 case

The LUD changed for my case today and they have issued a RFE. I dont know what its about but am hoping the lawyer will get the letter this week and he is working (with the holiday season).

My company is less than 100 employees so am guessing its ability to pay RFE but am not sure. My case is EB3 but my PD is 9/2001 so the EB3 retrogress hopefully should not affect me but am wondering if USCIS will take their eyes of EB3 cases after 1/1/2005 and i will again have to wait. like everyone else here, i wud just like my case approved and move on :)

Bhadradee: from what i recall...urs and my dates are very similar. r u in a company less than 100 employees? when did u get ur query? in my case, I contacted USCIS on Dec 8, 2004 after they published the processing dates on 12/6/2004 on their website indicating that they were processing 140's upto 1/7/2004. and i got a LUD today indicating that a RFE was sent out on 12/11/2004. What I am not sure is whether my action triggered the RFE or if it was bound to happen regardless.

What is your Degree and employee strength in your company..

My company is less than 100 and everyone inmy company got RFe for the Ability ro pay as Profferred wages as federal regulations..in 2002 and 2003
also requested w2 copies and company audited financial statmeents..

Rest of colleagues got cleared since the company was cooperating ..

Lawyer got within three days the RFE...Yesterday, also they asked educational eval..Mine is in EB2 -- So i have done eval shows Bachelors in Computers science and Nine years or progressive Experience...
I did thru Morning Star New york they are registerd with Immigration... Like Trust Forte..

my degree is MS but lawyer filed in EB3...didnt follow it that closely at the time of labor filing and may be now i will pay for it?

the size of my company is < 100 employees.

I have two other colleagues whose 140 has been approved. one of them already got his 485 approved and his labor is exactly same as mine (EB3). both 140s were approved without any RFE.

i am still waiting to hear from the lawyer to c what the RFE is about.

My degree is MS but lawyer took only BS for labor since I was substituting that skill. My BS is electronics and my eval also says electronics 4 year BS degree in USA. I might get a RFE for equivalency with CS but that should be easy one as I have seen similar such evals from trustforte that equate Electronics degree to comp. science degree.

My company has about 5000 people so I don't see any ability to pay issues.

yours should be an easy RFE since your company has a successful track record in such RFEs. You may have to redo the Eval. How to do the Eval depends on the exact wordings in the RFE.

What exact degree you have and what is required in labor ?

MY category is EB2 and they require MS degree or BS with Five year exper..

I have B.Sc degree + Post graduate Diploma + Nine years of Experience..

My attorney told me that Morning Star Eval will not Work..

How to approach Trust Forte for Eval..URgent. To answer the query..

Please let me know...
 
Heres my RFE info.

Got RFE on educational evluation. I did send single page eval from some evaluation services inc. I am getting a new one from TrustForte. Lets see how that goes. Do you know if you have submitted single/multiple page eval.

Yes Dee, I am sure trust forte can do the job. I have seen many such cases in this forum. What I will sugegst you is to post a detailed message with the degree majors and diploma majors, years at each etc. ( as much detail as you can) in the VSC 140 forum. There someone named unitednations is an expert at these issues and is very prompt at replying too.

Go to VSC 140 forum and read up similar posts and post soon.

I have already submitted over six years of exp letters showing progressive exp, and I am thinking they are fine as they just asked for educational eval. Let's see how it goes once we submit the response to the RFE.
