Queries about EAD renewal

Me and my wife is in EAD, approved August 2007. My next renewal date is August 2008.

My question is two folds:-

1. Should I apply for EAD and AP renewal online or by paper? I am currently residing in Maine. I may move out anytime as soon as I get a new project. The problem is if I apply online I might have to come back for fingure printing and photograph to Maine. If I apply using the hard copy, I might not receive the recipt before I leave.

2. I might change the job. Currently all my processing is done by my company lawer. If I chnage the job should I hire a new lawyer? What else is required by me to do? Both to get the EAD and AP renewal and other processes. My I 140 is with my employer, I do not have a copy of the same, will that hinder my processing in any way?
 
Go ahead with paper filing (avoid the fingerprinting). After changing job, using a lawyer is your choice however, you have to file a G-28 form to represent your new lawyer or self for all the applications (I-485, EAD, AP etc) pending at the service center. You can invoke AC21 clause for changing jobs, no, USCIS won't ask you to furnish I-140 copy (that belongs to the employer).
 
Renewal of EAD

Please Please advise, any info will help. I received my Green card last year in Sept 2007, however my wife's green card has not yet been approved. They say its under additional review. A service request was opened in Apr 23, 2008 and we have to wait for 6 months to hear from them (that would be in Oct). My priority date was Aug 2002. I have even approached the Ombudsman, but their office too says to wait for 45 days, that would be some time now.

My wife's EAD is expiring in Sept 2008. Should we apply for a renewal of her EAD or wait till her Green card comes. She doesnot work at the moment. So, will she lose her status if she does not apply for the renewal, also the fees are too high.... Should I contact the Ombudsman again? Will he help or does he not have a say if its under additional review...

Please advise, I am so frustrated with this whole process.

EAD is an optional not a must. If she is not working just let it go and no effect at all on her pending I-485

Do you think they will help in any way. Also, I hear that there are no visas available, they have reached the cap for this fiscal year. The next visa dates available will be only in Oct 2008.... Please advise, any info will help..................

They may help but, from my opinion, by only 0.000001%. Send them, you just loose few sents to mail the letters.
What visa you are talking about, as I understand it, you already have GC.
 
At the info pass appointment, the IO said that there are no visa dates to issue GC for my wife, hence we would have to just wait, till maybe OCt 2008.... That was her guess, as to why my wife's case is pending..... Any clue as to what the IO was talking about??? I have already sent out letters to the Congressman and the Ombudsman's office. Hope things work out, I am so damn fed up of all this.........

I understand it now. So, you get your GC when there is visa number available at that time and your wife case due to any reson not approved at that time. Now, the priority dated retrogressed again, there is no visa number availalbe for your wife case and consequently no approval untill visa number become available again. No letter to whomever will work then, you just have to wait till visa number become available again and your wife's case move forward.
 
EDA renewal ..?

Hi Gurus:
Please advise me on one situation that I don't know what to do:

I and my wife applied for EAD renewal in last May'08, my wife's got "card production ordered" on June 2nd week, and then mine one also received same status June last week, I recevied my EAD within 3 days of "card production" status,

Whereas my wife's are still the same status and no card mailed/received, and status also is not changed. My wife's existing EAD will be expiring on 1st week of Sept'08, and she is working now (she was in H4 before 1st EAD).

We created SR by calling USCIS two times, no result, today we called them again and they did SR for expedite action which they told would respind us within 5 days.

Now, if my wife doesn't get her EAD by expiring date, can she still work as her status shows card production ordered, and they said that your application has been approved but they don't know what happened after that.

I would request all guru people please respond if you know what to do.

Most likely she'd get her EAD before Sep 1st if IO claims that request to expedite it has been placed. however, you may take an infopass appointment and request the card thru the local office.

I personally wouldnt recommend working without having the physical card. Taking time off, if nothing else works, would be a safer option and hopefully the employer would be understanding enugh.

Thanks for your response. Actually, we tried to get INfoPass apponitment thru' web, but when showing calender it was not showing any date, only gray blcoks and was not working, still now I double checked, it is the same,

I answered it as Family based, thinking that is correct for a derivative.
Am I correct? Do you people see any issues in renewing the EAD?
 
What question are you referring to. If the primary applicant is employment based, then derivative is also "derivative of an Employment based".
Just had my EAD renewed. Though not on line, the paper is straight forward.
Question 15 asked for:Current immigration status: My lawyer aswered: I-485 filed
Question 16:Eligibility under 8CFR:
anwer was (c)(9).
And I am not the primary applicant for the petition.

The only time that I took an infoPass, i could get it for the day after next. But maybe I was lucky. You may also try calling their 18003755283 options: 1,2,2,6,1 Receipt # ,1,3,4. I did and could get thru to the operator who guided me thru the online form. You may try as well. That's my experience.

You may try... if you have time at hand... but the security personnel checks the infoPass appointment before he lets anyone in. So though its unlikely that you could just walk in, you may try. Again... my 2 cents.

Thanks, Seeklabor. Yes, I finally crossed this hurdle and received the card on 8/18. Here's what I could infer from my case: I saw an LUD on my prior approved I-140 (not on I485) and on the same day my wife EAD got renewed (she had applied in late May but I never applied for an EAD renewal). I am guessing that my wife's EAD renewal triggered our I485 approval. The IO handling her EAD, probably checked if her I485 was pending and since my wife is a derivative beneficiary, my I485 was probably checked as well. The fact that my PD was about to get current in Aug, the IO probably went on to check if my I140 was approved. Realizing that it was and PD being way back in 2004, (s)he put our I485 in queue for visa allocation. Well, just a story that i conjured up, since the I140 LUD and EAD approval dates are the same.

Well not a rule, but I'd assume for what its worth, anything that can trigeger CIS to look at your I485, its worth trying... EAD or AP renewal. But then there are a lot on trackitt who havent seen any LUDs and yet have got I485 approved. Strange ways of USCIS!

Yes, I agree with desperado140,
it would be: Adjustment Of Status (AOS) pending (OR I485 pending).
I also did paper based, I received my EAD renewal card, my wife's still "card production ordered" for more than two months!! took Infopass appt.

I guess paper based is better, you can avoid extra FP.

Any body got e-filed EAD receipt number starting with MSC.....?

Further they asked to mail the supporting documentation to "National Benefit Center, Lee's Summit, MO 64064". Did any body got this address to mail the supporting documents?
