qualify for DV lottery

Hi there,

My cousin is from palestine. She was studing in the US, but she overstayed her visa. Therefore she is illegal in this country. Does she qualify to apply for the DV Lottery?

First she must make sure that she has in fact become 'illegal'. I know that there are some areas of a student visa's eligibility that may not be so clear cut.
If she is in fact out of status, and she enters the lottery and wins then she will not be able to adjust her status in the US and if she leaves the US to do CP then depending on the length of her overstay, she will be banned from re-entering for a number of years.
If she is in status then she should make sure that she will be in status until september 2012, in order to claim a visa if she wins.

Yes he is right.
 
Is she still studying? If she is then as soon as her I-20 is valid she is in-status, even if her visa is expired. Why do you think she is "illegal" now?

Let him try in 11 yrs...The ban is 7-10 yrs for over staying so NO WAY!

Illegal is saying enough...he won't qualify that is why the US has the computers in which they can see all time lines...
