I have worked previously in the US as a Management Consultant under TN and an H1B visas so am quite familiar with the requirements. However, this time around I am not applying as an employee of my employer, rather I am an independent contractor (registered, but not incorporated), will remain in Canada and travel to the US periodically for business. The employer is a private LLC start-up based in Wisconsin, officially formed in January 07, with no official employees. Am I likely to encounter an issues related to this company's ability to sponsor me?
