Ladies and gentlemen,

Please let me know whether using AP invalidates H1.I am currently on H1 and is expiring mid feb.I am planing to Visit India and get married before I get approval and planing to return on AP.will I be able to use my H1 after getting approval once i return on AP and get my spouse on H4 ?.
Guys please reply asap, I am really worried ......

my lawyer said no

She said by using AP, you have to use EAD. If you use AP/EAD to enter USA, you give up H1. But you can go back to USA applying H1. In this way, you can bring her with H4, otherwise, you have to file I824, taking advantage of the "following to join" privilege.
