My husband has got valid I797 (H1B) through his new employer till Nov 2004.
I have not got my H4 renewed.
---- You should get H4 extension renewed.
My previous H4 is valid till 30 Dec 2003. Now I am filing for H4 extension
---- your H4 extension package should reach BCIS before your I-94 expire, better file it now.
1. How long it takes to get H4 extension (I539) ?
---- Depends on the service center, expect 3-6 months after filing
2. If I don't receive my H4 extension papers till 30 Dec 2003 will there be any problem ?
--- If you send your H4 extension now you will get H4 extension filling receipt and you will be in status. Fill up the form I-549, attach the copy of your husband H1 approval, attach the copy of His I-94 (front and back) and copy of your current valid I-94 (front and back), 2-3 recent pay stubs of your spouse, letter from his employer that he is working on H1b with them and request to extend H4 status of spouse till his H1 validity, Pay the BCIS fees $ 140, copy of marriage certificate and if you attach the copy of your passport pages it will not hurt.
I stay in Ohio and through the USCIS website I found 3 locations where I can send it.
1. Cleveland which is District office
2. Cincinnati which is sub-office
3. Nebraska which is the Service center.
I feel that I have 2 send it to Nebraska.
---- You have to send it to Nebraska service center and go to Nebraska service center and send the application to proper address for filing form I-539 for H4 extension. Clearly write out side of the envelope in bold” Form I-539 for H4 status Extension” also write in the cover letter what documents you have attached in order and BCIS fees check should be at top. send it by fedex or certified mailnso that you know when it reached BCIS
