Q regarding EAD

Hi,

I have a question regarding EAD.

I am under EB2(PERM) and got approved my Labor and I-140.

Can I file for EAD? (485 I can not file because of cut off dates)

EAD and AP are requested through formI-765 (Application for Employment Authorization) and I-131 (Application for Travel Document) respectively. Both these can be filed with I-485 application. If your PD is not current, you cannot file any of 485,765 or 131. The whole basis for approving an EAD/AP is that your 485 is "pending".
