My previous employer is holding W2 for 2003.

How can I get them as the Tax time is too close.

plzz help

Withholding of W-2 is a serious offense. IRS will be all over your old employer if he fails to issue W-2. Call IRS.

Try to contact Accounting office of your prior emloyer first and stress to them that:
"An employer is required to furnish a completed Form W-2 (copies B, C, and 2) to each employee showing their compensation and tax withholding amounts for the calendar year, generally, by January 31 of the next year."

If they do not agree tell them that you are going to contact IRS and file a complaint Form 4598.

"If you still do not receive your W-2, contact the IRS for assistance at (800) 829-1040, but not before February 16th. An IRS representative will complete a W-2 complaint on Form 4598, " Form W-2 or 1099 Not Received or Incorrect." A copy of the Form 4598 will be sent to the employer and a copy to you along with Form 4852 (PDF), Substitute for a Missing Form W-2."

So in the worst case you will receive a "Substitute for a Missing W-2" form directly from IRS.

I faced the same situation

I had faced the same situation from my previous employer for my 1998 w2 form. I called and asked for a copy of W2 , but he never did send any.

I filed my Tax returns using the last pay stub totals from the employer, and kept a note on 1040 form that i didn't receive W2 from the employer. It went all smooth and even got a refund form both state and federal.

You can file for complaint using Form 4598, but i didn't do it at that time.

So, no need to worry at all if you dont have W2, just file with your last paystub totals and everything will go smooth, i knew few of my friends did the same too ...

I was in your shoes last year. I had been to IRS to complain. They do have a complaint form. What they will do is send a letter to your employer asking him to send your w2. If he doesn't send it he will be fined $50. IRS doens't consider this as a big offence. Atleast, thats what I was told when I went to complain. If IRS is getting what it is supposed to get from the employer then, why do they care about us.

I filed based on my last pay stub and got the returns without any issues.
 
using most of the tax software , u can download the W-2 data directly into ur taxsoftware. According IRS every one must dispatch their w-2 forms by jan 31.

go to IRS website and download the data . Otherwise report this to IRS.

It's illegal - they have to send it to your last known address on file
