Proof of income for Retired Joint sponsor

Hey guys, ive got a delima, well my friend.

Her husband is her sponsor and her mother in law is her joint sponsor. She got RFE saying that the W2 or 1099 from the SSA is needed from her mom in law. Her mother in law income on her FORM SSA 1099 says $9000 for its net benefit but her 1099 R from her retirement system says $26,000. Will that be good even though the SSA is less that the amount required.
 
She gets $26,000 per year from her pension? Did she submit evidence of that?

Note that the MIL will have to meet the income requirement without combining funds with the couple, because she isn't the mother of the petitioner. As a result, she might need to provide evidence of both the $26000 from her pension plus the $9000 from the SSA in order to meet the requirements.

she did submit her 2010 tax return but they want the w2 or 1099. I just want to know if it is ok for her to submit the 1099r from her pension and from the SSA.

ok now she got another RFE saying to submit evidence of assests listed. I dont understand. Her joint sponsors income is $33,000 which is well over 125%.
 
just a little background. My Friend Sharon....her husband had a substantial lost so he grossed $13,000. So her husbands mother, who is married, became a joint sponsor. She grossed $33,000 which is well over 125%. So im kinda confused
 
What evidence did she (Sharon's mother in law) submit to prove the $33000?

Does she (MIL) have any dependents other than her own husband, Sharon's spouse (MIL's son) and Sharon? Has MIL ever been a sponsor or joint sponsor for anybody else? Is she or Sharon or Sharon's husband in Hawaii or Alaska, which have higher poverty line thresholds?
 
yeh she submitted both 1099's from her pension and from ssa. The only dependent is her husband and no she has never been a sponsor for anyone else. This is in NY. But she found her step mother to be a second joint sponsor. I just wanted to know why she needed a second so that the same mistake is not made again. Thanks

Also on the RFE letter, the words "find a joint sponsor" are underlined in red
 
Did she submit a new I-864 listing all her income totaling $33000?

Did she submit any documents for her pension to show the monthly/annual amount and length of time that she will continue to collect? A 1099 from the pension might not be enough, because the 1099 doesn't show if the pension income will continue at a similar or higher amount in the future. She should have also submitted some kind of statement or letter from the pension plan to show the extent of the benefits.

Joint sponsors who don't qualify as household members of the petitioner must have enough funds to meet the requirements without combining money with the petitioner or immigrant or other joint sponsors. So having two joint sponsors doesn't make sense -- use one joint sponsor or the other.

im sorry...it says "obtain a different joint sponsor"

Yeh they submitted everything....taxes, and 1099's for both pension and ssa. and yes there was a fresh I 864 with the correct gross income

I dont think they accepted her 1099 from her ssa. With a household size of 4, the MIL, her huband, her son and daughter in law..she is about a grand shy with only her pension. Thats the conclusion in leaning towards...so perhaps different joint sponsor would be necessary..any thoughts?

My point was that the 1099 might not be sufficient for the pension, because it doesn't show how long she is going to continue to collect benefits, or what the regular or minimum monthly/annual benefit is. Other pension documents would be required to show that she will be getting $X for a certain number of years or the rest of her life.

But if the other joint sponsor (stepmother) is employed, her income should be more straightforward to verify so it makes sense to have the joint sponsor be her stepmother instead of her MIL.
