Processing with PERM

I came in Sep01 and my 6th year is next year but my H1 is valid 'til Sep08 which I extended this year. My LCA had been pending since Feb03 - EB3/RIR.

I'm accepting a new job and doing PERM & EB2 but somebody told me that since my 6th year is next year - Sep07, Immigration might not processed my LCA or I-140/485 when they see that I'm with a new employer.

Is there truth to this?
 
If I decide to accept this job then I could apply for EB2/PERM even though my 6th year is less than a year away - Sep07...right???
