Agree :D Maybe they will start taking away new GC and next FY will start from Feb 2 1999 :) This just adds up to our confusion. Who is in charge to update these information? Nebraska Office? Maybe that is the reason they took away direct phone to Nebraska Office?? As shamshon said, Bunch of Incompetent Idiot Sickos. It is like working in the warehouse and not knowing that you have to ship orders, because nobody informed you. You would probably get fired. And we are talking here about THE BCIS, the homeland security agency that knows everything. This tells you how competent they are ... anyway, enough said about them.

We need more opinion on this topic. Any new approvals?? Ideas?? Informations??

Your lawyer is absolutely right, they cannot do that, period. We have been over and over this several times. BCIS has no authority to do such a thing, period.
As for the processing timeframe, they report to be processing applications filed on or before 16 Nov. That's a good new we discussed already like 15 days ago.
As for the other part of the timeframe, it is incongruent because simply they havent updated that yet, why? because they are running out of time, only one month left fot the current FY.
 
all make sense. Best thing to do is leave this issue alone until Oct 1, and then we will see where we are ....

The law is crystal clear: unused visa numbers are NOT carried over. Once wasted, they are gone forever, unless Congress passes a law authorizing an exception.

So we should not be propagating illusions here.

There is absolutely no pessimism in Gilbert's statement. It is only a clear explanation of the facts regarding this issue.
You can candidly wait for the unused visas to be issued, but the fact is BCIS is taking no action on that.
BCIS is just doing their work like human beings they are; not an excelent work, no the worst neither.
Only way to recover the unused visas is via Congress and we know how difficult that is. Maybe the most difficult part of that process belongs to us, and that is to be organized and stay together.

Even if BCIS management improbably (and in violation of their oath to follow the law) agreed to use the unused visa numbers, FAIR and other like-minded organizations would sue the government immediately--and win.

That is not being pessimistic at all. That is being realistic.

We all come from places where dictatorship prevail. However, this country is under something we call the "RULE OF LAW". Officials cannot act beyond power provided by law. The law says in plain English that only 10000 asylees can adjust EVERY FISCAL YEAR. This limit cannot be exceeded, period.

I am confused by your last posting. The dates that you wrote down

Notice Date: December 3, 1999

Are these your case dates? I know for a fact that you were approved some time last month. If these are your dates, then it is clear that the BCIS is keeping its word for the cutoff date November 16, 1999. Please clarify your answer.
