Processing after RFE

I was wondering if anyone has any idea about the following situation.

I got an RFE on employment letter, paystub etc. RFE was issued on 9/11/02. INS received my response on 9/26/02. It has been 4 weeks since they got the response and there has been no progress. I tried calling VT today. As the line was constantly busy, I gave up after sometime.

My wife's case still has the same old message "Finger Print results received. PRocessing resumed"

My question is : Can INS issue another RFE on some other stupid matter for my wife's case there by delaying the approval by another 3 - 4 months?

I have seen many cases where both husband and wife getting RFE together? Can the situation I mentioned above happen?

Usually...

they only send one RFE with a list of items that they want answered. I do not think that they are preparing another RFE for your wife.

RFE is INS wish

Please understand one thing that INS

1. Do not want to give Immigrant Permanent Residency
by default

2. As per LAW if are complying to all requirements they
cannot Deny.

3. The whole GC process is so delayed -That they want your
employment to be nullified.

4. Just think of what % of american companies can retail an employee for 4-5 Years, INS takes advantage of it.

5. The GC is defined looking at the employer not the employee.

6. As soon as you are laid off your GC is gone. Well now the new law states you can still find a similar job with a similar salary. Unless you are GOD's gift to America it is not so simple.

INS also know that how these employment GC seekers works their ass off to just retain the work. But that is how the system have been devised to take advantage of you.

Therefore any RFE's they sent are to be replied to. No matter when ever they send it-no matter how stupid it is- The main aim is loose your job and get you deported to your country.

So bear with it and do not grumble.

that shud be ur last RFE :-)

hey Kat

I don't think INS would be sending you or your wife any more RFEs. I'd assume your wife's application is being processed as your dependent ? Or does she work too, and her employers have filed her seperate GC application ?

well in the first case...it makes no sense why she would get an RFE. Uh..same goes for second casee :-)

Ha Ha sorry, hope that helped....
Hey Rajiv..your points are valid, but I try not to think like that

Avi and rav8tor thanks for your response.

Rajiv : I must admit, I was taken aback by your attack. I went thru your old posts and you seem like a pretty composed guy. That makes this ranting of yours even more surprising. May be this long wait is getting to you.

I hope you are equally good in taking the punch back. I noticed in an old post some one asked you if you are Gutka Ghatak. You said yes. I think you should get a "Gutka" shot to take some "edge" off. :)

I want to comment on only one point.

Therefore any RFE's they sent are to be replied to. No matter when ever they send it-no matter how stupid it is- The main aim is loose your job and get you deported to your country -

I HOPE YOU GET YOUR GC and DO WELL IN YOUR LIFE (here or in your country)

So bear with it and do not grumble - WHO IS GRUMBLING HERE?.

:)

Loot Gaya Jawani GC ke Peechey

Brother

Our situation is not Ghar KA not GHAT KA-Atleast my situation.

We are like Bali ka Bakra, how much we yell the fate is going to get us.

I call It Loot Gaya Jawani GC ke Peechey.- Again This is all my situation. (Please no offence)

I have lost 7 Years of my precious Jawani in this country-trying to look at the american dream. Now tell me what could be somebody's situation when you tell me to get deported or work in a gas station-illegally because INS revoked my I-140 in mistake and closed my case.

I do not even know what better will my life change to if I get a Green Card, only can say these 7 years got me something

This is Just my thought. (Please no offence again) In these 7 years I read most of the Immigration Law in USA, Please do not hesitate to ask me any question which I may answer for this community of Fellow waiters.
