Procedure to apply for Green Card through L1A visa.

Hello,

I am getting a lot of information from this forum and I thought I would write my inquiry here. I am currently on L1A visa since November 2003. My company is willing to sponsor me for green card however, I am not sure if my case is strong enough to get approved by BCIS. Basically, the company I am working for is a small, has two employees (excluding myself). The company recently opened another branch and has 1 full time employee there. What chances do I have to get approved for green card? If anybody has gone through similar process, I would really appreciate their input/experience. I am reading different articles and it seems like it will be tough but I would like to hear from people who have gone through the similiar circumstances. Thank you for your input.

Before giving you any input, I would recommend to consult an attorney. I had a similar process (L1A, small company, few employees). What the attorney told me is that in order to present a strong case, he needs to prove two things. 1-That I effectively had a manager position with the foreing entity before transfering to US, and that I currently work in a managerial capacity in the US in order to qualify for EB1 preference. 2-That the US and foreign company are still related and they are actively doing business. I don't recall him mentioning anything about revenue dollars or # of employees in both offices or branches. Basically, you have to be able to explain your manager role and # of direct reports in both positions in case of RFE.

Thank you sniper for your input. I really appreciate it. I have consulted with couple of immigration attorneys but most of them says the same thing that I need to have some professionals (have degrees) working for me and I should have enough revenue/profits to support those professionals. I work for a small company and I have three sales associates working for me but I can't show that they require degree to get such job. I was in the managerial position in the foreign entity and we still are doing business together. so, I am confused as to what to do. If you don't mind asking me this question, but were you able to get the approval for Green card in your case with small company, few employees?
