I just talked with my athorney. I hope these information can give us a clear picture where we are standing:
His office contacted VSC and asked about when they will start October cases. According to them. It will be at least two more months for them to start Oct. cases. They mentioned few reason for why it is taking them long to start the Oct cases:
1. They are mainly fucosing on H1 cases now.
2. They are short in Visa #. ( When I asked my athorney when they will have new Visa available he mentioned at least another two months, but it could take later than that. He confirmed that other service centers doing faster than Vermont and he said more August and Sept. cases were filed in Vermont than other Centers.

Lets hope for best and embrace ourselves for a long wait. I am not sure if writing letter to our state representative can be any help.

Thanks, this certainly confirms our suspicions that the H1 prioritization has somehow impacted I-485s as well. However, the 2nd item on visa# shortage is unclear to me. Isn\'t this a matter that varies per country, not service center ???

That is good point. I always taught there are also a yearly total Visa # that need to be available. I will ask him next time.

With the apparent change of priorities, VSC is now concentrating more on H1\'s...and that might go on till who knows when...with this year\'s quota being 195,000+ (guess 75% of the quota is coming VSC\'s way)...and with other service centers processing 485\'s at a good pace plus Consular Processing taking a bite out of the EB immigrant quota...VSC might be stuck in the infinite loop of August-September-October (99) for a loooong time to come...

It\'s frustrating to say the least...

From what we\'ve seen at VSC, they\'ll actually start processing cases for any given month before they advance their official processing dates to that month. e.g. they have been processing sep99 cases even before they said they were doing that. VSC has this habit of playing it safe. So, I\'d actually expect oct99 cases to be taken up for review in the next 15-30 days. As far as visa# not available, I think they are referring to the fact that although they have processed a lot of cases, in aug99 and sep99 they can\'t issue them any visas since their PD is not current. If they could then they could have claimed a much faster rate of processing.

I fully agree with you AquaLung. Every time anybody calls they always give a very sadistic answer. Visa is not available to the applications whose PD is not current. I saw one Oct99 (country other) approval early this week. VSC is saying that they are processing cases received aroung 15th sep99...does this mean RD around that date or ND ????

I will ask my athorney again about the Visa availability, but I am country other and my PD is current and he was referring to my case. Lets hope they complete all Aug-Sept cases soon, since all of us are in the same boat. It looks like number of applications that became current for last Aug. and Sept. were much higher than other service centers. I totally agree with you that most of the time VSC mislead us.

140,000 visa\'s were available when the date rolled over from 9/30/00 to 10/1/00. Add to that the additional 130,000 visas made available by the new law. If your attorney says visa is not available for you when PD is always current, ask him what he is smoking? because he is surely not in touch with reality.

An IIO told me. I tried to get some more clarification but was not enough to make any sense.

My dates are current too and my FP were done 8/30/00.When i spoke to IIO on Jan 11 she mentioed that my case is in the process and it will take 120 days.AVM had changed last month to "This kind of case takes 365-540 days".

IIO told me visa numbers not available even if my PD is current EB2 India, PD 4/98, ND Aug99

You should have told the iio that your PD is current and that visa availability is not an issue. I think this IIO must have been yapping out this answer to other EB3 India filers and gave you the same response.

Looking at the VSC list on immitracker.com, I do see that most of the cases past Sept 14 99 are not yet approved. (There were a few exceptions )
Hence your assumption of a MONTHLY visa allocation may be very true.
