Problematic H1 transfer

Hi there!!
I really need advice.

Currently I am working on H1b for non profit organization A which was exempted from the H1b cap. I will be ending my contract in july 2007. I am concerned and wants to know if I will come under h1 cap if I apply to company B which comes under h1b cap or else i will be exempted from the cap since its a transfer but not a new h1b.

If i come under cap than please advice me and let me know that how early should i apply for the h1 to start my next job in august 2007 and not getting affected by cap.

I will appreciate any kind of help and thanks.
 
The rule is, if the one trying to get cap subject H1B has never been cap subject before,
s/he will be cap subject. Cap exempt H1B --> cap subject H1B, B/F/L --> H1, etc,,, all these cases are cap subject when getting new H1B.
You'll come under cap when you apply for H1 with company B.

If you want to start aug 2007, you need to apply for 2006 quota,
which starts in April 2006.
