Problem With I-140

All,

My company filed labour with following requirement.

MS or bachelor with 5 year of progressive experience.

I have only 4 year of experience when I joined my sponser company.

I am working with my gc sponser company from last 4 years.

So total 8 years of experience. My question is Whether BCIS
consider my experience with current company or not.

Please suggest what are my options.

---- IF the lawyer has written 5 years progressive experience then you should have 5 years experience before joining the employer the exp gained with the LC sponsor employer will not be counted. Your all the past exp letter should have word Progressive exp written on them

------ I don’t think they will consider it. Talk to your lawyer immediately who filed your case in EB2 and ask him what to do, how he filed the case when you don’t have 5 years exp? FYI the EB2 cases are getting more RFE than EB3, many good lawyers are filing EB3 even if the future employee has more than 5 years exp and MS degree. In EB2 more salary has to be shown and RFE at LC time or I-140 time for more employer financial documents if employer will be able to pay that salary.
