Okay so i filled for a passport under the child act law of 2000!

So my problem is this! I been schedualed for the oath cerimony and its on oct 24th. for my n400

I want to attend taht but i send my greencard to the passport agency and I know they wont give my gc back till the application is finished. They been lagging and I was wondering if i should rescudual my oath cerimony? or just show up to the ceremony without my green card and tell them i couldnt find it and ill send it to them later or lost it?

If I do rescedual on the paper it tells me to put down the reason why? I dont want to tell them the truth that i filled for a passport cause they might deny my n400 all together.. So should i tell them IM working that day? or do i gotta watch my son? What excuse will be sufficient enought to reschedual my oath ceremony without rasing any suspicious questions about why i dont have my gc?

did you check the status of yr PP??. What does it say. Did you apply expedited??? You can call them at 1-877- 487-2778 during 8.00a.m. to 10.00p.m EST and find the status

Don't be in a hurry to reschedule yr OC. You can do it even a day before your OC.

Yea i checked it.. These idiots told me to wait till firday cause my files been put back for recirculation.. and they sent me 2 letters asking for the same thing twice... I called and they said .. 2 diffrent casw workers must of seen my case.. the first letter stated that i need to send them proof of living with my step dad for 2 years.. then i sent that they recieved it on firday.. thent he same day they sent out a letter requesting the same thing asking for the 2years proof and now.. also my adoption papers translated..

I freaking sent that the first day i applied for the passport.. these guys are idiots... my koseki tohon has all that information on there and is translated... How the hell there gonna send me 2 notices asking for the same damn thing .. especially sent out the same day they got my evidence? Now they told me to call them back 2 days later cause he doesnt wanna pull my papers out of circulation caus ethen after that he will have to put me in the back of the waiting list again. "idiots"

Besides how can i reschecual my oc the day before.. when it tells me to mail them the letter? there gonna get the latter earliest the day after the oc.

Since you were already a citizen and eligible for a passport, you should have filed the N-600, not the N-400. I'm extremely surprised that the error hasn't already been caught and your N-400 denied.

On the brighter side of things, you're already a citizen. If your N-400 gets denied (even if you attend the oath ceremony and obtain your naturalization certificate, the decision can be reversed down the line), you will not be denaturalized. If worst comes to worst, the USCIS will invalidate your naturalization certificate and you will have to reapply for a CITIZENSHIP certificate by using the N-600. Indeed, this is a very interesting situation.

What do you mean reversed down the line.. now im getting scared!!

No need to get scared. If it's determined that you qualify for citizenship under the Child Citizenship Act, you will be issued a passport. However, if this determination is made, you are not eligible for naturalization, as you are already a citizen. This is why I was referring to filing the N-600 instead of the N-400. When the USCIS approves the N-600, the applicant receives a Certificate of Citizenship; when the USCIS approves the N-400, the applicant receives a Certificate of Naturalization. Although both certificates provide the same end result (U.S. citizenship), they are issued when distinctly different sets of conditions are met. If worst comes to worst, you may have to file the N-600 to obtain the correct certificate.

If you attend the oath for N-400, USCIS may revoke your naturalization certificate upon discovering that you qualified under the Child Citizenship Act.

Reschedule the oath so your passport application has a chance to be processed until approval or denial. If the passport is approved, withdraw the naturalization application and apply for N-600. If the passport application is denied, go ahead with the oath for the N-400.
