Problem In Continuing Cp

Hi,

My case may be very unique. I need an urgent help from you guys.

I have filed my I-140 and was requesting for CP. But during the meantime as per the advise from someone I also filed I-485. After my I-140 approval, the case was forwarded to NVC for CP and they have created a case number for me.

But later when I was trying to include my wife name, they found that I have filed for both CP and I-485.

So I have withdrawn my I-485 and the withdrawal acceptance notice was sent to my lawyer. My lawyer sent the withdrawal acceptance letter to NVC and asked them to do the CP. Now two weeks are passed by and when I checked my case with NVC it still says the case is with USCIS and I need to contact them.

When I called USCIS couple of days back they said I have to file I-824. But my casenumber was already created with NVC and why do I still need to file I-824? But I think the form I-824 should be used for some other purpose and not like my case. PLEASE ADVISE ME WHAT CAN BE DONE AT THIS SITUATION?. I filed with Nebraska Region.

Do I need to wait for some more time till i hear something from NVC?

My H1 is getting expired in Aug-2005.

NVC may have sent your file back to USCIS. In order for you to continue with CP, you need ask USCIS to send your file to NVC again. That was probably why USCIS asked you to file I-824. Try to talk to NVC operator to figure out where your file is.

My lawyer have already sent a letter to USCIS to forward my case to NVC. To I need to wait for some more time?. How long can I wait before calling them? By the mean time I will talk to some NVC person about this.

All I worried was about my H1B status. If I file I-824 and if it takes its own time, I cannot extend my H1B.

Does anybody have any other suggestion?
