problem in I-864 with pending I-130, I-485 and I-765
Hello everyone,
I came here last Mar2004 with a B1 visa to undergo training for a certain company but ended up marrying a USC on July2004. On Jun2005, I gave birth to our baby boy. Last Oct2005, we've started my papers and submitted my I-130, I-485 and I-765 all at the same time. After 2 weeks I received my receipts noting that the next step is my biometrics for I-485 and I-765 but received Request for Additional Evidence for I-485 instead after 3 weeks. Last December 22 I've decided to call USCIS to ask about my biometrics and finally received it after a week for a schedule on Jan 4, 2006.
My problem is the deadline for my Form I-693 (Medical Exam & Immunization) and I-864 (Affidavit of Support) is at the end of January and I haven't receive my EAD yet. My husband is currently unemployed. I have an Aunt who's willing to submit an Affidavit of Support for me. Is my husband required to file I-864? Can he still submit an Affidavit of Support even w/o his W2s for 3 recent years and current employment certification? What's the chance that I will receive my EAD even if we can't submit the Affidavit of Support in time (considering we have a child already that we need to support)? It says in the RFE that failure to submit it will result in a denial
