I have one question regarding the citizenship. I am in the process of filing the Citizenship. I got DUI back in 2000. I paid all the fines and I was under probation for 6 months. I did not complete the full probation and the officer written in the case that he was unsatisfied. but I got discharged from the probation and from the DUI case as I moved to different state during that period. Will it effect my US citizenship case?

Thanks

As I understand your post you have not completed the terms of your probation and the officer was dissatisfied with your performance? And the only reason you say you were 'discharged' was because you moved? Yes, that will be a problem in your case. You will need a certified copy of the court's disposition on your case and that will reflect the issues noted above.

Did they inform you that charges were dropped because you moved or are you assuming they were because you were did not satisfactorily complete probation?

Thanks a lot for the quick replies. I got the "Petition & Order for discharge from Probation" from the court and it says

I respectfully petition this court to discharge the defendant from Probation for the following reason:

Discharge from Probation without improvement failed to complete alcohol classes

That's what the letter says. Please let me know if its an issue or I need to do something.

Thanks in advance

Did you contact the court or probation officer as to what steps need to be taken? Being discharged from probation doesn't mean charges were dropped. If probation isn't completed to satisfaction, the court may issue a warrant against you to face the charges again. Contact the court and find out what needs to be done. The last thing you want to do is apply for citizenship with an outstanding warrant out on you.

It could depend on the State Laws that placed you on probation but my reading of that notice is the probation was discharged (canceled) because you did not do as you said you would in order to get probation instead of a jail sentence.

That means there is almost certainly a Warrant outstanding for you. You should contact that Court and find out what the status is.

Because of the arrest, you are going to have to contact that Court anyway to get a certified copy of the Disposition to include with your N-400 Citizenship application.

If there is a Warrant then there will be no Disposition as yet and that will almost certainly guarantee a denial at the N-400 interview.

I am NOT a Lawyer but you should talk to one as your debt to society is not yet paid until the case is closed with a satisfactory Disposition date.
