probation and permanent residence

Hi all,

One of my friend had probation (deferred sentence) for 12 month for DUI which is going to expired on feb 2006. He had adjustment of status interview yesterday based on marriage. everything went well excpect they told him they cannot give any immigration benefit for the prople on probation though he paid all fines and served community service. Is this a rule?
