Probable reasons for RFE s now

Posting the same here as shantanu B was appreciating Habib's prediction , (couldn't take it)

Here is the probable reason for RFE, that I could gather after reading some articles in murthy.com and after going thru previous murthy chats

This is no brainer. Go to murthy.com and search the previous chats and article by attorney Sheela Murthy. For quality control purposes RFE is issued for one out of five AOS applications. That is for 20% of the cases. In this soft economy where in most of the major companies had layoffs, and because of the sept 11 attacks, INS wants to make sure that the applicant has a job and also continuous presence in some cases. Obviously they don't want to issue green cards to the people who will become a liability to the governament. They don't want people to get the GC stamping and apply for UB 40 form.

this is the reason why they are asking for employment letter, tax returns for the last two years (which most of the attorneys submit along with the 485 application) and recent pay stubs.

Also if you have subscribed to the murthy.com weekly news letter there was info stating that INS no more asks for the previous tax returns (earlier it was a must). Probably IIO's still have the hangover of the old rule.

Answer : Good chance that the INS will issue RFEs in majority of the cases, since often updated info is needed before INS makes a decision. Another common issue that arises is a problem with the photos not conforming exactly to INS specifications and having to be redone.

So guys we may see more RFE in future, but do remember that RFE is not a ghost it just delays your approval by 2 to 3 weeks.
Lets not allow these stupid guys who always post negative info, effect the spirit of this forum. RFE so what.

My attorney submitted tax returns of the last two years along with my I-485. I dont remember whether he sent W2's with 485.

laws are always bias against immigrants

Especially the ones who are seeking GC thru employment-sponsorship. Government want GC applicants to be always employed even though the economy is currently stagnant. Dont want to approve those w/out jobs because they dont want these to apply for unemployment benefits. I think the question should be why the GC seekers who worked for years contributing obediently a large amount of their salary for the taxes that are used to support those in the welfare, suddenly barred from getting the benefit that is due to them, just because the economy is weak? Why would the government think professionals like us who filled up the void in the IT industry when badly needed, now finds ourself struggling to get GC just because the government thinks we are potential welfare candidates?

There are a lot more useless,unemployed citizen of this country who are a burden to us since the first day we worked for so many years and we never complained. I hope the government wont discriminate against us immigrants just because we dont bitch and whine hard enough.

Very well said.

I guess everything in life has a price. This is the price we pay being immigrants. The "lazy, burdensome" americans u mentioned are reaping the benefits of their ancestors who stepped on this land first of all. Ofcourse, govt. won't treat us as first child because it is not made up of immigrants in majority.

Additionally, pre-9/11, things weren't this bad. Bad economy+ 9/11 are testing times for the immigrants to prove their worth.

We are not un-used to adversity (are we) and have been winners under the most odd situations, fierece competitions etc. Once we come out of this fire succesfully unblemished, we can take pride in being really successful and time-tested. Just take this situation as an exam of life and hold on to ur ground.

I hear you. Thats what capitalistic economy is made of. Why are people being laid off even after contributing to an organisation for 20 years???
