hey I saw your post. and I have a question to see if you could help me.
I am married to a USC last year, but recently I found out that he actually is also dating with another girl and I want to divorce with him. but we have our interview coming on 2/4. and I want to know that if I divorce with him now will affect my 2nd marriage in the future? I mean what if I am going to married to another USC in the future, I know that I will have the same paper work apply to immigration again, but my divorce will affect anything? thank you.

i am not really experts :rolleyes: , i have NO idea about your history with "USCIS" and your case STATUS .

i am highly recomended you not to divorce untill you get your LPR , maybe divorce does not reflect on your case since its not frequently . :D

If you get a divorce now it will be very, very hard to keep your GC. Unless you can prove (without a doubt) there was some form of spousal abuse. I would suggest contacting a lawyer. If you get your GC - you have two years to wait until you are no longer Conditional. If you can stick this out I would do it. Otherwise - there will be some battles and hard/uncertain times ahead of you. I would stick it out for 2 years and try and bail after I become non-conditional LPR.

xyz2008, I believe you can withdraw your I-485 and it should not affect a future AOS application based on a new USC spouse. What would be worse is if you don't intend to continue your marriage with your current spouse but go through the interview for the sole purpose of an immigration benefit, then you can have a problem in the future.
 
If Xyz2008 entered the country on a K-1 visa, then she cannot AOS under another US citizen's (new US spouse) petition. She has to leave the US.

I actually entered the country with J-1 visa and changed my status to F-1. but if I divorce with him now, am I going to immediately become illegal or there is another way for me to change my status just to keep it legal?
