EB-3 Relief: By unanimous consent, the Senate also passed a measure sponsored by Senators Schumer (D-NY), Hutchison (R-TX) and Kennedy (D-MA) that would recapture EB -3 numbers lost from FY 2001-2004 due to processing delays. 50% of these numbers would be allocated to Schedule A occupations. Both the H-2B relief bill and the EB-3 relief provisions will now be included in the Senate version of the supplemental appropriations bill. However, since neither of these measures was included in the House-passed supplemental, they will be discussed when House and Senate conferees meet to resolve differences between the two bills. In both cases, AILA will urge the House to recede to the Senate on both the H-2B bill and EB-3 relief.
 
EB3 Visa Numbers recapture included in Conference report

A joint conference to hash out the differences between the senate and the house was held .... fortunately the EB3 recapture survived !!!
Now it is upto the voting on the bill HR 1268, it seems it should pass

Immigration

The provisions on asylum, the border infrastructure, and driver’s licenses are included; the alien bond and surety provision was not included. The conference bill also includes the Mikulski amendment regarding caps on temporary seasonal workers (H-2B). H.R. 1268, a bill that was primarily intended to provide supplemental appropriations for defense, the global war on terror, and tsunami relief, has been passed by both the U.S. House of Representatives and the U.S. Senate. However, it contains some important immigration provisions. The House and Senate announced on May 3, 2005 that they have reached an agreement on the final wording of the Bill. This Bill is not yet enacted into law, but is expected to be signed by the President, which will finalize it into law.

The Bill would amend the provision of AC21 that released certain unused visa numbers to all employment-based categories. In H.R. 1268, 50 percent of these employment-based visa numbers are allocated solely to Schedule A cases, which affects nurses and physical therapists. This would be quite helpful to nurses and physical therapists, occupations in high demand in the U.S. It would also be helpful to address the current retrogression problem in the EB-3 category. Of course, this is a short-term solution. Details of this Bill will be made available in our May 6, 2005 MurthyBulletin and on MurthyDotCom.

It is much less generouse than the Senate bill!

As part of the Tsunami/Iraq spending bill Congress is set to pass this week, Congress extended a provision in the American Competitiveness in the 21st Century Act of 2000 that allowed unused employment-based green cards from 1999 and 2000 to be reclaimed for later years. The new law allows for the continuation of this practice for the years 2001 through 2004 as long as the numbers are allocated for nurses and physical therapists (Department of Labor Schedule A occupations) and as long as the number used does not exceed 50,000.

The green cards should become available immediately after President Bush signs the bill next week, but it is not clear how quickly consulates will move to issue the approvals. The bill is not quite as generous as an earlier version approved in the Senate that would have allowed all 140,000 of the potentially available unused green cards to be reclaimed. Half would have been available to nurses and the rest would have been available to all other workers.

Wondering how this will affect the EB3 retrogression? I hope they let the nurse applications use only this 50,000, so thel other workers under EB3 can use all other visas.

Hi, my company applied for PERM in the end of Aug. Is there any remote hope of it getting approved before the end of sept?.

so what does this retrogression mean now. I am in EB2 and my lawyer is preparing to file before Sep end. If we do make the date, would INS process my application? My labor was approved just last month and Priority date is May, 2003.
 
It means for your case....

If you file 140/485 together before the deadline then you can avail EAD and travel authorization benefits, but you will not be awarded GC until your PD becomes available before the retro date. So you can be happy in one way. I suggest since you are going to apply for EB2 140/485, you also apply EB3 140 side by side with the same labor, you can do that for a mere 200$. That way you can be sure that if something bad happens to you at 140 stage in EB2 case, EB3 case will be ur backup. Atleast you can go back on H1 immediately. Talk with your attorney regarding this. Also with EB3 140 you cannot apply EB3 485 as dates are not current with EB3 cases.

Thanks for the reply and the clarification. Wish I could ask the lawyer for EB3 as well. Company lawyer. To lower costs, will do only as minimally needed! Will hope and pray for the best. :)
