Priority Date Retrogession?

Hi Guys,
on EB3, what is the current priority date? I was recently interviewed and approved but no stamping since priority date is not current!

What is the current priority date you guys think?

MY RD is oct2002 and priority date is Jan 2003

Current Prority date is Jan 2002 for EB3 who born in India/china/Phil

And you Prority date is your Labor applied date.

you said your RD is OCT 2002 and priority date is Jan 2003... I dont think its correct senario....

Please check your receipt datses..... Check your i-140 approval notice for Prority date...


When you say, you got recently interviewed and approved but no stamping since priority date --- "Did they said you are approved, and not going to stamp your passport beacuse of Prority date. in that case did they sent approval letter to you."

Post some more details......

Could you please post your Approval date and correct Priority Date cuz. your PD should be earlier than RD which is Oct 2002.

The current priority dates are 01/01/2002.

Could you please once agin confirm your PD and RD. PD will be before RD, and it is the date your Labour was filed.

If what you describe above is correct that would confirm a report on the Murthy website that the last time dates were not current this was the way cases were handled by centers, except for CSC. i.e. They would process and approve you even if your PD was not current, but would not stamp until PD became current.

Please do confirm your PD and 485 RD's. This could be BIG NEWS FOR PEOPLE WITH PD's > jan/2002 !!!!!!!!!!!!!!!!!!!!!!!! WE WOULD SOLVE THE PUZZLE OF HOW CASES WITH PD > JAN/2002 WILL BE HANDLED........

If this is correct, then we can also assume that visa numbers are not assigned until they stamp the passport. :confused:
 
I think desiguy is not genuine

Many people are trying to fake these thing to mislead others. Offcourse Rajiv khana chat scripts specifically told that it happened (stopped stamping) in CSC when PD is not current. But this guys case seems to me fake.

And the answer is "yes", Individual who are in this sitiuation have to file for extension else what proof you going to give to your HR for I-9 Form once your EAD expires, just approved words are not enough. Just my opinion!!

If true... There are couple of things....


If we need to extended EAD/AP if it expires....
and

We need to stick to the same shit company until the Priority dates become current and WE CAN NOT TAKE ADVANTAGE OF AC-21 BEING THE 485 IS APPROVED...

THIS WILL BE MUCH MORE WORST

I am GENUINE :-)

Well sorry for the misunderstanding. My priority date is jan 19 2002 and not 2003.

When I was interviewed, they said current priority date is Jan 1 2002. And they are expecting it to progress by a month in february.

Also, they WILL NOT stamp your passport if visa numbers are not available. They will approve it but will wait for sure.
 
As we seen in the desiguy case...

CSC processing is doing things in a different way as they did before.

1. Approve 485 application even though PD > jan 2002.
2. But they will keep you wait until the PD is current to get the passport stamed and getting GC card.

But this is confusing,
As per this case, the visa number is getting allocated when the passport is getting stamped or during GC Card.

but

A Case from VSC: One of friend whose 485 got approved on December 11ths and the PP stamping is done on Jan 11th. His PD is october 2002. But If we think the Visa number is allocated at the time of PP stamping, then how come my friend who went a day before Desiguy got the visa number.

What this tells us is, CSC is processing the cases in a different way than other processing centers.

Complication's, Delays within USCIS departments and with in USCIS scervice centers.......

What you guys think.....
 
Well this is what the Immigration officer had told my lawyer:

"Visa number is required only when they are ordering the card for you. They can approve and stamp you if they want but only delay would be in getting the cards due to PD retrogession or whatever. BUT, CSC is the only service center which will not stamp your passport until your date is current. Other service centers may or may not stamp it but CSC does not for sure"

Interesting.

There are some rules and some grey areas within USCIS ways of working. Whatever rules are there (which keeps on changing ), some centres will follow it, some may not. (in short, rules are also a grey area). We are seeking GC in interesting times of USCIS !! :rolleyes:

I have a question regarding the address proof by seeing your signature. I have currently moved from my current addres for last 6 months. My labour PD is March 2002 and my 140 and 485 was filed on March 2004 and 140 got approved on June and FP is done on Dec 10th. I see that mine and my wife's LUD has been changed on 28 th Dec. There after no news at all. I haven't informed USCIS about my new address since I am in the last stage now. I am afraid, if it will be come a problem or not. I see in your signature that an RFE to submit evidence to demonstrate where you and yours principal spouse are living. Will it be a problem for me.Please let me know your thoughts....

Hi binoypthomas,

When I moved from Kansas to Virginia I reported my address change to USCIS. they have my latest address on their file.

In my RFE they asked - "to submit evidence to demonstrate where you and yours principal spouse are living." Beacuse, They might want to make sure that still we are living togeher. But I dont think because of my address change.

In MY RFE for my wife it says : Prove that you are not going to become public charge.... by providing EVL 0r I -134 or Bank leeter....

Basically they want to make sure, I am reday to take care of my Wife.....and to make sure that once we get GC we are not going to become public charge by applying Unemployement benifits.....


My advice is : if you think you are going to live in current location for long time , you can report address change..... or if there is some one to take cre of your mails in prevoius addess ( what is on 485).... you can leave it as it is.....
