Priority Date Query

Hi,

I applied for GC thru my previous employer when I was in US during the period 1999-2001. During that process, my labor and I-140 was approved.
I was waiting for PD to become current to apply for I-485 when I was laid off.

I came back to US in 2004 and applied for GC thru my current employer in March,, 2005. I am awaiting for Labor approval since then.
My question is, Can I use the priority date of the previous GC process for the current GC process?

I appreciate your help in clarifying this point.

----one can use early PD if I-140 was approved and not revoked by USCIS or employer.

How do I find whether my previous GC process was revoked or not?

I appreciate your guidance.
-------------- I think the past employer may have used the LC approved for you for other person. If it was Desi company they may have filed other I-140 for new person and may have revoked earlier I-140. if you know the lawyer who filed I-140 try to find the info, he may or may not give you info as I-140 is employer petition. do you have I-140 filing reciept copy or I-140 approval copy or I-140 reciept#??

Past employer location? where did he file LC? where did he file I-140?
was that Desi?
Location of new employer
did new Employer when did he file LC? RIR or PERM?

Some more info

Hi Ginnu,

On further research, I came across an email (it was there in my mail box) from my previous employer attorney that I can use my previous priority date with the current GC process. This info was communicated by the attorney in 2001 but I completely forgot about it. I sent them an email now to ensure that my case was not withdrawn. Meanwhile, when I went to USCIS site and gave my previous labor LIN number to check the lateset status on that case, it shows 'I-140 approved on so and so date in 2002.........'. I guess this means my case is not withdrawn. Anway, I am waiting for the response from the attorney office.
