Priority Date issue

whats your thought on this
It mentions that it might affect people as early as Jan 2005, Lot of us are in the Post 140 all they way to waiting for interview date stage
and some like me at the P3 Review stage.

How does the PD retro will affect any of us who are in the CP boat anticipating the Interview date say in 2-4 months time frame.

Will there be any effect ?
We all must be very very time conscious at this point i agree.
Also there was some disucssions around when the visa number is assigned
Is it safe to consider when the P3 goes to consulate in india that your visa number is assigned.

I believe that Priority dates becomes immaterial once the NVC starts processing the case .

That what I found in the sea of immmigration information over the net

Again not a lawyer but an applicant like you

I think from the info i collected reading various threads,
Im under the assumption that after NVC reviews the P3 and completes the review and passes the case to Consulate, before doing that it requests a Visa number thats what is counted against the GC quota.
So if your numbers for your country at that point is over then the case will hang in the P3 Review stage until the visa numbers are available

Again not a lawyer applying Logic to the problem and understanding how it works
and this is the reasonable conclusion i can get.
IMO we are safe if the case gets moved to the consulate, until then we are up in the air..

Does any one have hunch what could be new priority dates, if they move back for EB3?

My PD is Oct'02. Just wondering, if they move back, Would I be safe or not?

I didn't know that this will cause so much controversy. Im sorry if you got hurt by this news. ok coming to source... my friend works in a very big corporation. his attorney from Berry, Appleman & Leiden LLP have informed this to my friend. His PD is DEC-03. My friend applied for I-140 and I-485 concurrently recently and attorney told him dont dream about I-485 until 2007. they got this info from AILA meetings. I really believe this info is true. Lets wait and see when this will be official.
