priority date for EB2 used for EB3?

Hello,

I got my LC and I140 approved in EB2 category about 2 yrs back, and then I changed jobs.
Now I am planning to apply for my LC again. Only this time it most likely will be in EB3 category. 2 questions:
1. can my priority date with EB2 be used with the Eb3 application?
2. If not, should I try to go for Eb2, given that atleast for
now the priority dates are both current. How much might they
differ in the next 2 years?

I ask this because my compnay is ready for filing in EB3 category
immediately, but for EB2 I may have to wait for a month or so
and by then who knows what may happen. I may not be able
to file in RIR category anymore if the situation gets worse.

thanks

1. No you cannot.

2. To put opinion on which category should application be applied on i.e. EB2/EB3 - you need to tell the SESA from which you intend to apply.

No one knows for sure how much will they( EB2 and EB3 ) differ in two years.

Thanks for your reply!

I am curious as to why the priority date can't be reused.
From LC point there is no difference in EB2 or EB3 category
right? So why should I not be able to reuse the priority date?
My application would still be EB3, only the date would be
as if it was filed 2 yrs back.
Could you please shed more light on this?

thanks

I assume you have changed your company from the one that sponsored your LC last.

LC is company specific - job specific. So that means your last LC is with company that applied it and not you. That is why you cannot use old priority dates.
