Priority Date EB3 Preapproved Labor ?

Hi Guys,

Is the priority date for the person or for the labor? If I do a labor transfer will my prioity date be the date I apply for 140 or the date when the labor was applied before for other person?

If the priority date is the date I applied for 140, then what is the use of the labor transfer for EB3 as I am not eligible to aply for 485 for 3 years an accrding to the new labor rules I can get a new labor and also get 140 approved in 3 years?

Please let me know if I have missed any thing in this???

Hi Guys I think some people are confused about the priority dates.

Please read the link about PD from murthy.com,.... This PD date is not a new thing. It was there long before in 2000. See the article which posted on 2000.


In Simple english.....

Who ever initiated the GC process after landing in USA first,will get their 485
processed first irrespective of whether they filed 485 or not.
Who ever got their 485 approved are OK and lucky.

msdn2006 thanks for responding to my post. From the article you mentioned in murthy.com it is clear that if the applicant has filled for labor then his priority date is the day application was received at SESA. If the applicant directly applied for 140 then the day 140 was received at uscis will be his priority date, but with a pre-approved labor what is the priority date? From your reply it sounds like the day the person applied for 140 not the day the labor application was received by SESA which was filled for some other person.

If this is the case then I still have this question. What is the use of preapproved labor if I cannot apply for 485 immedeatley. By the time I would be eligible for 485 I would have got a fresh approved labor applied on my name if things really change at labor department starting from 1st January.

I am asking this question to know if it is useful to join a company who promisses a preapproved labor for EB3 category.
