Priority Date 101 - Question

Hi Guys,

A very basic question:

What exactly is Priority Date, especially with regards to I-485 stage. How does it impact the rate of processing of the 485 stage.

In my case, my employer used a pre-approved Labor Certification for applying my I-140 (IN NOV 2001). So will my 485 Priority date be the date the original Labor was approved (in 1999) or will it have a date based on my 140 or 485 RD/ND. Do they really process 485 applications based on the PD info ?

Your PD does not matter at the I-485 stage. It all depends on the RD.

It was helping in determing the eligibility of applying for second level of GC that is i -140. Before you apply for i-140 the Visa Processing Date" for Your country( ex.INDIA) should be current.( employment base)


for last One yere is it current so it does not have that much importance at present.
