Can a previously applied 140 be used for another person, if its withdrawn....

Hi,

Can a previously applied 140 be used for another person, if its withdrawn....

For eg. if the 140 applied for anohter person is withdrawn....can it be used for another person...will there be any problem/issues/RFE's....


pls give me your inputs.....

An I-140 can never be reused, since it is for a specific alien. The underlying labor certification, on the other hand, can be reused. Where things get interesting is if the original beneficiary ports to another employer using AC21.

I haven't seen anything definitive on the subject, but I personally would not feel comfortable if my employer was reusing an LC where the original beneficiary had used AC21 and the I-140 had been withdrawn.
 
Thanks. But the 140 was not used for this labor. 140 was applied & the employer applied for withdrawal.I verified, the labor was not used for anyone. Do you think its good to take....

So you're saying that this LC was used with an I-140?

I verified, the labor was not used for anyone. Do you think its good to take....

Did the original I-140 beneficiary port using AC21?
