I worked in US from Oct 2004- Nov 2005 (Issued in 2004) on H1B visa for a US based company (Lets Say A).
The company was taken over by another comapny B.
I joined another firm C in the US for 2 months and got my H1 transferred .
I then decided to move to India.
Company B offered me employment in India and I have been working them ever since.
In the last 7 yrs of my employment comapny B was taken over by comapny D.
I now intend to work for comapny D in the US.
Question:
I have been told that since I just used 1 yr of my last H1B and have had a valid H1, I may be able to re-apply for my H1 and should be exempt from the new lottery system.
Does this reasoning hold and If I apply for H1 again should I be able to get thru the process without any issues ?
