I am a QA Engineer in a Data Networking field.
I have BS and MS in Electrical Engineering. But when I joined the company one month prior to obtaining my MS degree.
I also have about 6+ years of industry experience in software development + Testing.
Now my company is applying for my green card.
My job requirs BS+5 years of experience; they could not use my MS since I joined one month prior to obtaining my MS degree.
I am in the bay area ( San Jose, CA) and I am making 83K. I was told by my company attorney that I dont have the prevailing minimum wage; She says that Prevailing wage requirement for my job to go through EB2 is 100,000
I have the following questions
Q1:- Is the prevailing wage for EB2 for California set at 100 K or can it be lower than that depending on the job description?
That is depending on the job description, can it be around 90K?
Q2. If I had been able to use my MS for my PERM case, would same Prevailing wage requirement apply?
