prevailing wage

The salary mentioned in my LC application (RIR) is 96% of prevailing wage. (level II position in OWL - Mechanical Engineer). Will it be a problem for granting LC? Is it necessory that salary offered should be equal or more than PW?

Since OWL shows only two levels, how the intermediate positions are treated? If the job requires BS in Engg + 6 yrs experience what level this position will be treated?

Experts! help me. What is DOL's recommended other wage source for LC?
 
An employer can also pay less than the prevailing wage as long as the actual rate of pay is within 90%-100% of the prevailing wage.

does the rule(employer pays at 90%-100% of prevailing wage) is a genernal rule (applicabe to all states) or a rule specific to a particular sate?

Also. does it required that such pay rate be implemented at labor certification stage or at I-140 stage.

That is not a rule. It is guideline I belv. RFE can be avoided most of the time if it is followed. If there is an RFE after this - employer can give in writing that salary will be increased to whatever was promised in LC after person gets GC and that letter is good with 90% salary - as it shows intent for the amount - that is the logic.

I have seen cases for $500/Annum difference ppl have got RFE, but still it helps in most of the cases to be as close as possible.
