Pre completion OPT and H1b

Hello,

My pre completion OPT (PhD) is starting on aygust 13th. I have a job offer and the employer wants to file for my h1b for 2006. I have a few concerns and I will appreciate advice, suggestions and answers

1.Does the fact that I have not yet completed my degree affect my chances of getting an approval?
2. since the H1 would be for 2006, when does it become applicable and I tranist to H1 from f1?
