Pre approved Labor... Is it possible?

Hi,

I know a few of my friends, who work for a company (more than 100 employees) who got pre approved labor which eased their Green card process, and their green card process got finished in less than 1 year using pre-approved labor.

Anybody has any idea what exactly this pre approved labor is?

Ofcourse its not just RIR being done. Its more than that. One of my attorneys whom i spoke to about this, tole me that, in some cases, some companies apply for a green card for, say, person A, and after that person's green card process reaches I-140 stage, he either decides to leave or they fire him. In that case that person A can be substituted with person B, if the profile matches for both A and B. Is this true. Any of you out there have seen this happening?

Any suggestions or responses would be greatly appreciated.

Thanks,
Sri

What your lawyer told you is right

It is possible. But, the profile should match well. Otherwise, INS may reject it and deny your I-140.

This would be called a LC substitution case. You would need to have met all the requirements for the position when the LC was submitted to DOL/SESA.
