Hi Everyone,
My h1b interview is on November in Chennai consulate. My wife is already in US on h1b and also I have already mentioned in my DS-156 that she is working. My consultant is advising not to mention that in my application form as i might be considered as potential immigrant. I don't want to modify my forms now.

My question is :
is it a problem in telling the truth that spouse is already working in US? Have any one heard/faced the similar scenario? please advise me.

Thanks

---------- consultant is giving wrong advice, tell the truth on applications and Interview if asked. H1 visa is DUAL intent visa. ask him does he know that H1 has dual intent?. potential immigrant intent is checked for B1/B2 visa
I don't want to modify my forms now.
---------------you should not

-----------dont lie

Have any one heard/faced the similar scenario?
---------many have spouse on H1 and got H1 and if you have H1 approval and the company in past not commited any immigration fraud and your education certificates/exp letters are Genuine and US employer HAS job for you thenI dont see any problem with your H1. nothing in the law prevents you having your wife on H1 and husband getting H1.
please advise me.

Thanks
