Recreational use of marijuana has been decriminalized in many states (I believe as long as it is under a certain amount). I see far more people openly smoking pot in NYC now than before. Maybe in your case the cop did not feel it was worth the effort of reporting you.

Why would he have confiscated it if it was in a decriminalized state? Anyway - more importantly- if you follow the legal arguments, it is still illegal at federal level and therefore a problem for any immigration related reason. This is why even in decriminalized /legal use states, LPRs are warned against possession and use.
