Had pot confiscated twice but never been fined. Will this affect my naturalization application? Already passed interview.

If you were completely honest on your Application and passed the interview . Then no it wouldn't affect your application .

Ok but I didn't get to tell the interviewer that I did get some confiscated without fine or anything. Will they still be able find out that I had some confiscated?

if you got no fine or arrested/detained . There is no record of that , sounds like the cop gave you a break . Lucky you !!

Does you “didn’t get to tell” the interviewer mean that you answered no to a question you should have answered yes to?

Yes and does it matter if I have no record to show for it? Well it affect my n-400 application? Like I said there was no fine, no detention, nothing they just confiscated it.

Kinda the "opposite " of being completely honest!!

If you answered no to a question you should've answered yes to!!! You were dishonest, when you were sworn to be honest!! I now see ths reason for your concern .

If you get your citizenship and down the line let's say ever get arrested and the authorities decided to dig deeper . They figure out you lied on the citizenship app. That's a serious offense !! .

Did the cop just stop you search you then let you go ? If so no record of that as the cop did you a solid and let you go !!

Were you ever handcuffed ?
Placed into a police car ? He would have to fill out a report !!

There would be a record of that because technically you were detained !!

Hence the question have you ever been detained or arrested on the n400 application.

Im assuming this incident happened after your biometrics but before your interview ?

I am pretty sure that if a policeman confiscates a controlled substance they have to record the details of that action, including who they confiscated it from, somewhere.

They searched and let me go. No handcuffs, nothin. It happened before I applied for n400.

So on the form, how did you answer the question that asks “Have you EVER committed, assisted in committing, or attempted to commit, a crime or offense for which you were NOT arrested?”

(If the pot was confiscated, it was clearly an offense in the jurisdiction you were in.)

Can you give me a reliable source for your claim?

Don’t you think it’s logical that they control controlled substances? You think cops have carte blanche to take drugs from people with no obligation to report it, log it, store it till it gets destroyed, all on record?

Well I guess the other option is the cop took it for his own use.

But here, you can read about it on quora https://www.quora.com/What-do-the-police-do-with-drugs-after-the-drug-bust
Or google it

Google 'if a policeman confiscates a controlled substance'
You get arrested along with that confiscation. so it's safe to say the cop didn't do his job for whatever reason . Whether good or bad !! Maybe he performed an illegal stop and search and figured it wasn't worth the headache !!

The pot was only less than a gram I don't think they would go through all that process for less than a gram of weed.

Not necessarily, read the articles linked. Sometimes they do just confiscate without arrest, especially if the amount is just possession rather than dealing.

Bottom line is OP lied on his application and now will be forever worrying that something will turn up when he least expects it. I guess best advice we can give now is if he gets away with it this time to make sure he stays out of trouble so that this doesn't come out in the future. As many people here know, often the fact of lying under oath/on an official USCIS form carries a worse penalty than whatever you lied about.

Recreational use of marijuana has been decriminalized in many states (I believe as long as it is under a certain amount). I see far more people openly smoking pot in NYC now than before. Maybe in your case the cop did not feel it was worth the effort of reporting you.
