Hello all,
I just had a lengthy conversation with my lawyer (who by the way is good.. he had a bet with me that I won\'t get a RFE and he won) about the stupid 90 days stay with the sponsoring company after getting the I485 approved..
He said, the clause is irrelevant now because the AC21 law negates that. After the passport is stamped, neither INS nor the employer have no legal grounds to invalidate an I485 because of various reasons such as no evidence of wrongdoing, AC21 job portability. Currently, right after the passport is stamped you can leave the employer ASAP and that I should not fear about anything... I am going to get my passport stamped and then deal with the current employer... it takes times anyway to find a job in the current market condition...
