Graduated May 1998, the law states that I am in status for 60 days following the graduation date. That would bring me to July 1998. I stayed until Dec 5, 1998, which means a total of 194 days. Was I out of status for purposes of the 3 year ban? I understand that if you leave the US before 180 days after the expiration date on your I-94, you should be OK. Mine was "duration of status".

Please, I need this info fast as I am applying for new work visa...

Thank you,

I'm posting this on behalf of my friend who is in a similar fix.
You can reply to him directly at west2525_7@hotmail.com if u prefer.

From searching earlier postings I noticed that you might have been potentially out of status on F1 before. Did that cause problems when you applied for your H1/L1 papers/visa? Could you please shed some light on what happened & how the INS and/or you managed to sort it out?

Thanks.

Need more info. When did your I-20 expire? What were the dates including day, not just month. Did you apply for OPT? If so, when? Was it approved? Did you leave the US on Dec 5, 1998? Did you come back to the US after that, if so when?
