Hi,
I am a new member and thankful to all for information.
I meet the criteria of 1095 days and applying for citizenship now.
Meanwhile I am getting overseas job opportunities (say Middle east / Europe). I (with family) can leave Canada after applying for citizenship. However I am few questions.

1. Do I need to maintain residential ties?
2. I am planning to get the non-resident status (leasing house/closing bank account etc.) for income tax purpose. Does this effect my citizenship application?
3. Does it help if I apply for citizenship through a law firm in Canada? (to get the non-residential status, I should not maintain any address in Canada. So thinking of showing law firm address in the application instead of friend)

FYI- My contract is for three years.

Thanks,

you will be interviewed at the time you do ur test.
If cic suspected that you recently came to canada to do your test
(passport stamp) they might send you for a Hearing with a Judge....

At the same time its good to keep your address and bank accounts....
until ur done with ur Citizenship test

What If We Dont Show The Passport At The Time Of Test??

Folks- I have received the Citizenship test appointment. The following items were asked to be bring for test

1. Letter of invitation
2. 2 ID's with photos
3. PR Card and Record of Landing
4. Current/Expired passports.

What is the significance/consequences of not showing them passport as if shown the stamps on passport will reveal that I have not stayed in Canada for the period it was required.
What if I tell them that I lost my passport?

Any experience/advise will be highly appreciated.

In either case you will be referred to a judge for hearing.(waiting time is between 6 months to 36 months!!
They will ask for police report if you tell them that you have lost your passport and you will also need to show evidence that you have lived in canada for 1095 days!(student records, bank statements.....).

My suggestion is withdraw your application before your test
and apply when you have accumulated 1095 days.

Thank you Ehsanvan......I will call CIC and withdraw my application. I think instead of taking a chance I should backout.

Do you think it is a problem if I am called by judge. My case will be further delayed (apart from 15 months of processing time). I will be loosing 35% as tax if I maintain tie-up in Canada. I am not able to make decision to leave Canada or not, before the getting citizenship.

All, Please help or share your experience.

Thanks.

Well as far as I know going to a judge doesnt mean you will get your citizenship!!
CIC judges are really experienced and they would know right away if
you have lied.....
They could charge you since you have given them false information.
for sure you will ruin your future chances by being dishonest .

Citizenship

Hi Ehsanvan,
There is nothing illegal or dishonest in my case. As per CRA (Canada Revenue Agency), you don’t have to pay taxes in Canada if you don’t have any ties. The clearance is approved by CRA to not pay taxes once you apply to them (NR73 form).

I am looking for some body, who applied for citizenship and left Canada without maintaining any residential ties. I called CIC office, they are not clear on this, of course they are customer service people who is there to answer FAQ.

Thanks

Do not worry - if you have fulilled the physical presence test for citizenship, you are safe. The "ties" law for immigration purpose is different than that for the tax purpose. Also, the ties do not matter these days for citizenship. The requirement is that you should be a legal PR of Canada till you become cdn. Therefore if you leave Canada after applying and at the time of taking the oath of citizenship you are a PR of Canada (by fullfilling the 2 out of 5 year presence rule), they cannot deny you citizenship.

There is no rule of "intent to reside in Canada after getting the citizenship" for cdn citizenship (like they have for the UK citizenship). Even if you are called to see the judge, it does not mean that your case will be turned down. You can keep all proofs of your 1095 days presence ready.

Good luck!

sa7797,
The key is, did you provide false information on your application form or not?
The answer to that will determine your best option.

Thank you Ehsanvan......I will call CIC and withdraw my application. I think instead of taking a chance I should backout.
