I want to start full time MBA this fall 2006. My spouse has filed for Green card labor certification in 2004,he hasn't received it yet .But I have been told that since that shows 'immigration intent' it will be impossible and is not advisable for me to apply for F1 visa at consulate.Doing mba on H4 prevents me from summer internship ,OPT,and getting a job to pay off the student loans. Please advise if is difficult to get student visa in this case!!It's frustrating to be waiting for GC endlessly and at the same time being denied from studying/OPT because there is a GC pending!!Thanks in advance.

You can always change your status from H4 to F1 even if you have immmigrant intentions within US.

It has been done successfuly by several people in this forum and I have personel experience on that. But if you go out to stamp F1 visa in your pp in your home country US consulate (especially in India), there is no guarentee you will be issued a F1 visa.

Go and change your H4 to F1
