Porting PD from EB3 to EB2 (same company)

Hello gurus,

Here is my situation.....
My EB3 140 approved with priority date 01June2002 --> Company A

My EB2 140 pending with priority date 10May2006 -->Company A (different title...future position)

Can i port my EB3 priority date (June 2002) to EB2 application & apply I-485?.If i do, will my EB3 140 gets invalid?.I will need to file 3 year H1B extn(in Oct) based on my approved EB3 application & don't want to loose my approved 140.

I am in a similar boat and my lawyers say that we can take the best of both the approved I140 ... meaning you end up with EB2 PD June 2002. I dont know about the job requirements.

Did you get a chance to speak to the attorney? What did they have to say?

My PD June-2002,EB 3,INDIA
I-140 under approval in Premium processing
I am also interested to know if I can file in my company different position by PERM and get the advantage of old PD.

I am BE + 23 years and by error file in EB3
Can I change I-140 to EB2?

My lawyer says labor goes with I-140 so U cannot change Eb3 to EB2 in filing.
