WHAT IS THE EXPENSE INVOLVED IN DOING PERM LABOR AND I-140 AGAIN?

Here are my details,

Company A (consulting firm) labor Eb3 priority date Jan 2002,
Moved to Company B filled Eb2 with priority date October 2002
Company A (Eb3) was approved in September 2003, Moved back to Company A applied 140 & 485 in dec 2003
EB3 140 was approved in Jan 2005 (485 dates were retrogressed to Jan 1, 2002,
otherwise should have had 485 approved same as concurrent filled 140& 485 were approved together, missed 485 dates by 2 weeks)
Mar/Apr 2005 dates current for couple of months till it went unavailable around July 2005 and to 1998 in Oct 2005.
Joined Company B again in October 2005 on EAD - did not file AC21
Got Approval for Company B (Eb2) in December 2006 from Back log Elimination Center
Applied Eb2 labor in premium and got approved in Feb 2007 with priority date October 2002(did not port eb3 as dates are current)
Attorney sent AC21 along with approved i-140 requesting it to attach it to pending 485
Lud on March 10,
Called 1-800 number and received response after 4 weeks that they are currently processing the case , because of additional review it is taking more time ....
Still waiting for approval.....

I am thinking of calling again .. Also I did my figure prints in Feb 2006, How long they are valid ?

I have a self-petition EB2-NIW I-485 pending.
Now I have another I-140 approved for the petition filed by my employer.
When I received the approval for that employment based petition I-140, I noticed that I was given the same A# as the self-petitioned NIW case. Does it mean that the "Interfiling" happened automatically? Do I need to file the second I-485 for the employment based petition now?

Can you please give me some feedback.

I have an EB-3 140 approved with PD2003 at TSC. Recently, my EB-2 140 was approved with PD Oct 2006 through PERM at NSC.

My 485 was concurrently filed under EB-2. I wanted to port the PD of the EB-3 to EB-2. But both of them are already submitted.

My question is, is there a letter/form you guys may share that we may use to request for porting the priority dates? Also, where do we send it to? Address for such requests.

My I485 was approved last month after attorney send a letter(in March) to port PD from EB3 to EB2 petition, yet to get the card though. Spose got her card in a week after approval

Where should I send information to Port my priority date - like address for Nebraska and whom should I address this information.

Send to Service center where your I 485 was pending.

You can use below format for cover letter. Send all your receipts through certified USPS mail. I sent 2 I140's , I 485 for me and my wife. VSC to TSC transfer receipts (both), New company H1 approval copy, 3 months pay stubs
and Pearson memo from this link. USE COLOR PAPER for cover letter!


Here is the format I used for interfiling request.

“Interfile NEW APPROVED I 140 to pending I 1485 application” (make it bold and center in your cover letter)

-------There are two ways. 1) While filing second I 140 you can request them to port old priority date from already Approved first I 140 2) If you have two approved I 140' already, then you can ask them to inter file Old Priority date I 140 to your pending I 485 aplication and ask them to approve based on old Priorty date I 140

just the details like filing date, receipt # and approval date.
----Copy's are good enough
Otherwise, If you don't have any copy's then Receipt numbers are good enough with simple documentation- Just a cover letter

Any inputs appreciated...for my case.

I have approved EB3 I 140 and Labor PD is july 2002 and my 485 still pending in NSC from dec 2004 , tho all checks cleared as per infopass appt.

1.Can I port my EB3 to EB2 with the same employer?
2.what are the steps to do after applying Perm LC and I-140?
3.Is it possible to apply with same employer or do i need to change employer?
4. I have total 4 yrs non IT exp+10yrs IT exp(which includes my 6yrs exp with this same GC employer)?
5. Can My present GC sponsor port my EB3 to EB2 by changing my grade level ..to higher post than my previous Labor certificate shows..

Any help please

i have another question:
basically i applied for 140 on pre-approved EB-2 labor at company B (not yet on their payroll) and its pending. the PD is in 2003.

i am goign to apply for 140/485 based on my original EB-2 labor at company A (current employer). the PD is in 2007

my plan is to port the PD from 140 on pre-approved labor to the new 140 for original labor.

now what happens if the Company B revokes the 140 based on pre-approved labor after its approved? can i still use the PD date? or do i need to apply for interfiling before they revoke it?

you mentioned if i dont have the approval notices, receipt numbers are good enough. are you sure on that?
